Webcast on Increases in Post-Payment Insurance Audits

On Thursday March 15, at 7:00 P.M., John W. Leardi, Esq., of Buttaci & Leardi, LLC, will appear on the radio program "Labor Lines," broadcast on WGBB 1240 AM.  "Labor Lines" is a weekly radio program hosted by Victor Fusco, Esq., of Fusco, Brandenstein & Rada, P.C., that focuses on working men and women and the organizations that represent them.

Mr. Leardi will be one of three guest panelists on the hour-long program, joining Dr. Michael A. Bernstein of the New York State Chiropractic Association and John M. Kelly of Practice Compliance Consultants, Inc.  The broad focus of the panel's discussion will be on the recent increase in post-payment audits being conducted by the insurance industry, and the impact of these audits not only on the targeted practices, but on the chiropractic profession as a whole.

The program will be simultaneously webcast on www.am1240wgbb.com, and will be re-aired over the radio and via the web on Saturday March 17, at 6:30 P.M.

 

Predicting of outcomes in non-operative treatments of chronic low back pain

 A study in the November 2006 issue of the European Spine Journal revealed that systematic reviews have shown that as non-operative treatments, exercise, behavioral and multimodal treatment programs are effective for chronic low back pain.

There is, however, a lack of knowledge concerning the association between changes in treatment process variables and changes in outcome for the three treatment forms.

The results showed that functional coping mechanisms and pain reduction were associated with a decrease in disability and increase in return to work (RTW), and physical performance factors were not.

Related to pain reduction decreases in disability, functional coping mechanisms as well as physical performance factors were associated.

Strong conclusions cannot be drawn from this review, because of the heterogeneity and the limited number of studies. The results of this review raise the question if changes in behavioral variables and reductions of disability which facilitate an improvement in function, may be more important than physical performance factors for successful treatment of chronic low back pain.

This is relevant for the refinement of future treatment programs.

Whiplash injury and Oculomotor dysfunctions:

Another study in the European Spine Journal looked at Oculomotor dysfunctions as being hidden causes of invalidity following whiplash injury. Many patients with whiplash injury grade II present oculomotor dysfunctions related to input disturbances of cervical or vestibular afferents.

Oculomotor rehabilitation can resolve the impairment of vestibular function but if therapy is delayed or the patient has been wearing an orthopedic neck collar, more therapeutic sessions are required.

In conclusion, without rehabilitation of the oculomotor muscles other therapies are not sufficient to recover the impairment caused by whiplash injury.

ACA 2007 Legislative Agenda

The ACA Board of Governors has approved the association’s 2007 legislative agenda, which is aimed at making chiropractic more readily available to veterans and all active-duty military personnel and pushing for the revival of the Patients’ Bill of Rights.

All provisions in the Patients’ Bill of Rights are designed to “level the playing field” for doctors of chiropractic by including anti-discrimination and federal-liability language, and would allow DCs the ability to go out of network in the appeals process.

Moreover, it is ACA’s goal to achieve chiropractic inclusion at all major military treatment locations worldwide, and to ensure that doctors of chiropractic are commissioned in the uniformed military health system.

To date, chiropractors have been employed at only 30 veterans’ facilities. With low back pain a leading ailment of those returning from Iraq and Afghanistan , ACA will work to extend chiropractic presence to all 150 major VA medical care locations.

Other 2007 ACA initiatives include:

  • Ensuring that doctors of chiropractic are active in federal programs including the Public Health Service, National Disaster Medical Service, and the National Registry of Certified Medical Examiners.

  • Making certain that doctors of chiropractic are treated fairly in all attempts to restructure the Medicare physician reimbursement system.

  • Reviving federal anti-trust legislation that would allow doctors of chiropractic to collectively bargain with managed care and insurance companies.

ACA will also monitor any congressional attempt to establish association, or small-business, health plans. These are fatally flawed proposals that would allow employers to escape state coverage and provider mandates. ACA will also watch for any attempt to usurp chiropractic scope of practice laws at the federal level.
