ACA SUES FEDERAL GOVERNMENT

Chiropractic is in crisis. As you may know, within the next few months, current Health Care Financing Administration (HCFA) federal regulations could be imposed that will allow Medicare managed care plans to substitute as a benefit spinal manipulation performed by competitor providers such as medical doctors in place of spinal manipulation to correct a subluxation performed by chiropractors. This means millions of patients may be denied their right to receive chiropractic care!

This crisis involves more than Medicare. In many states, the managed care regulatory model is utilized by the private sector managed care plans. This means that chiropractic services, now effectively eliminated from most Medicare HMOs, could also be eliminated from the nation's private sector managed care plans!

Let the Battle Begin. The ACA is beginning legal action against these regulations to keep them from going into effect until they correctly reflect the will of Congress, which is to ensure that Medicare Part C beneficiaries have access to chiropractic services by chiropractors. This lawsuit will be a difficult and expensive undertaking, but it must be pursued, regardless of cost.

The time is now. We can't afford to wait. According to George McAndrews, ACA General Counsel and the lead attorney on this case, the full implications of the new HCFA regulations represent "the most serious challenge to the welfare of the profession since the AMA conspiracy to destroy chiropractic."
